General Terms of Service
Service Provision
Pacific Language Centre Limited, trading as Pacific Language Consulting and Training (hereinafter referred to as "the Company"), agrees to provide training and consulting services as described in the service agreement. The scope of services will be outlined in detail in the agreement.
Payment Terms
All training fees must be paid in advance. Training sessions will not be held unless payment in full has been made.
Confidentiality
The Company and its clients agree to keep all confidential information obtained during the course of the engagement private and secure. This includes any proprietary materials, client information, and training content.
Intellectual Property
All materials provided by the Company remain the intellectual property of the Company. Clients are granted a non-exclusive license to use these materials for personal or internal business purposes only.
Liability Disclaimers
Limitation of Liability
The Company is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to, loss of profits, business interruption, or loss of information.
Accuracy of Information
While we strive to provide accurate and current information in our training and consulting services, we do not warrant the completeness or accuracy of the information provided. Clients should verify any critical information independently.
Training and Consulting Specific Disclaimers
Performance Disclaimer
The success of our training and consulting services depends on various factors beyond our control, including client participation and effort. We do not guarantee specific outcomes or improvements.
External Examination Results
The Company does not guarantee results in external examinations such as the IELTS. Performance in these exams is influenced by multiple factors outside our control.
Fitness for Purpose
The training and consulting services provided by the Company are designed to support education, English language, and linguistics development for teachers, university students, and business professionals. While our team of experts holds advanced degrees in English language teaching, linguistics, or related fields, we are not licensed practitioners in law, medicine, or other specialized professions.
Our materials, guidance, and consulting services are developed based on current best practices and academic research in the field of language education. However, we make no representations or warranties regarding the accuracy, reliability, completeness, suitability, or fitness for a particular purpose of the training and consulting services provided.
The use of our services does not constitute professional advice in legal, medical, or other specialized fields. Clients should seek appropriate professional advice for specific issues or concerns in these areas.
Client Responsibilities
Participation and Engagement
Clients are expected to actively participate in training sessions, complete any assignments or practice tasks, and communicate openly with their trainers.
Use of Materials
Clients agree to use the training materials provided by the Company solely for their intended purpose and not to distribute, copy, or share them without permission.
Cancellation and Refund Policies
Program Changes
The Company reserves the right to make changes to training programs, schedules, and content as necessary. Clients will be notified of any significant changes in advance.
Refunds
The Company agrees to refund any unused training fees in the event that it is no longer able to provide the training and consulting services as provided above except as set out in the force majeure provisions below.
Scheduled Training Policies
Advance Notice Requirement
Clients who are unable to attend scheduled training sessions must notify the Company at least 24 hours in advance.
Special Circumstances
The Company understands that sudden illnesses or work emergencies may prevent clients from attending scheduled training. In such cases, please inform us as soon as possible, and we will consider these situations on a case-by-case basis.
Compensation for Missed Training
If advance notice is not provided, and there is no compelling reason for the absence, the Company will not offer compensation for missed training sessions.
Examples of compelling reasons include but are not limited to:
Sudden illness
Work emergencies
Unforeseen personal emergencies
Rescheduling Policy
Clients who notify the Company at least 24 hours in advance may have the opportunity to reschedule their missed training session, subject to availability.
No-Show Policy
Clients who fail to attend scheduled training without prior notice and without a compelling reason will be marked as a no-show. No-shows are not eligible for compensation or rescheduling.
